On August 5, 2025, Bybit sent a terse email to its Brazilian business users. The message was not a request for feedback—it was a sequence of technical instructions with hard deadlines. By August 21, users must complete supplementary verification. By September 21, open positions in restricted products would be forcibly liquidated at "current market price," unsupported fiat balances converted to USDT, and bonus funds confiscated. By September 24, the account would be migrated to a local Brazilian entity.

This is not a story about a new DeFi protocol or a Layer-2 breakthrough. It is a case study in how a centralized exchange executes regulatory compliance under pressure. And the structure of that execution—specifically, the choice of liquidation price—deserves the kind of forensic dissection usually reserved for a smart contract audit.

Context: The Brazilian Regulatory Shift

Brazil’s Central Bank (BCB) enacted Resolutions No. 519, 520, and 521, effective February 2, 2025, bringing virtual asset service providers (VASPs) under a formal authorization, supervision, and monitoring framework. The rules cover operational standards, customer protection, governance, security, disclosure, and anti-money laundering controls. Bybit, like many international exchanges, operated in Brazil without a local license. The new framework forced a choice: exit the market, or restructure to comply.

Bybit chose the latter, but its approach reveals a design philosophy that prioritizes legal risk minimization over user experience. The plan is a multi-stage state machine: verification deadline → account restriction (no new positions) → forced liquidation plus fiat conversion plus bonus forfeiture → entity migration. However, the critical missing parameter is the list of restricted products. Without it, users cannot plan. They cannot hedge. They cannot choose to close positions voluntarily to avoid the forced liquidation. The asymmetry is stark: Bybit has full information; the user has partial.

Structure outlasts sentiment.

The Contrarian Angle: A Strategic Hedge, Not Just Compliance

The conventional take is that Bybit is simply complying with Brazilian law. That is true, but incomplete. I see a deeper strategic calculation: Bybit is using this forced migration to reduce its own liability exposure in a market where regulatory uncertainty is high.

Consider the bonus forfeiture. Bybit is effectively canceling promotional liabilities. In a bull market, such bonuses would be honored. During a regulatory transition, they become a drag. By tying the forfeiture to the compliance deadline, Bybit legally justifies the write-off.

More importantly, the choice of "current market price" over "mark price" may be a deliberate risk-management decision. A mark price would require a reputable index, which could be challenged if the price deviates from the open market. By using its own market price, Bybit retains control.
